This Privacy Policy (hereinafter, the “Policy”) sets forth the basic principles governing the handling of personal information and other data relating to users (“User Information”) by Ohkoshi Shoten Co., Ltd. (hereinafter, the “Company”) in connection with the operation of the Company’s online store (the “Site”).
All persons using the Site (hereinafter, “Users”) shall review and agree to the contents of this Policy prior to using the services provided through the Site.
Article 1 (Scope of Application)
This Policy applies to the handling of all User Information acquired by the Company through the Site.
The handling of information separately obtained by third-party websites, applications, or services linked from the Site (e.g., payment service providers, delivery companies, social media platforms, etc.) shall be governed by the privacy policies and other terms established by those respective providers. The Company bears no responsibility for such handling.
The Company complies with the Act on the Protection of Personal Information of Japan (the “APPI”), as well as all other applicable laws, regulations, and guidelines, and will appropriately handle User Information.
Article 2 (Definitions)
Unless otherwise defined in the APPI, the key terms used in this Policy shall have the meanings set forth below:
“Personal Information”
Information relating to a living individual that can identify a specific person, such as name, date of birth, address, telephone number, email address, credit-card information, and any other identifiers (including information that can be collated with other information to enable identification).
“Personal Data”
Personal Information that forms part of a personal information database, etc., as defined under the APPI.
“Retained Personal Data”
Personal Data for which the Company has the authority to respond to requests for disclosure, correction, etc., and which the Company is permitted to store for longer than six months.
“User Information”
All information collected by the Company in connection with the User’s use of the Site, including Personal Information as well as cookies, device information, log data, browsing history, purchase history, and age-verification information.
Article 3 (Types of User Information Collected)
The Company may collect the following types of User Information to the extent necessary for operating the Site and conducting alcohol-beverage sales.

Article 4 (Purposes of Use)
The Company uses the collected User Information for the purposes listed below and will not use such information beyond the scope necessary to achieve these purposes.

Purposes incidental to the above, and any other purposes for which User consent has been obtained
If the Company changes a purpose of use, such change will be carried out within the scope reasonably related to the original purpose, in accordance with the APPI, and will be publicly announced on the Site.
Article 5 (Provision of Personal Information to Third Parties)
The Company will not provide Personal Information to third parties except in the following cases:

Where the User has provided prior consent

Where required by law

Where necessary for the protection of life, body, or property and obtaining consent is difficult

Where particularly necessary for improving public health or promoting the sound upbringing of children and obtaining consent is difficult

Where necessary to cooperate with a national or local governmental body in executing legally prescribed duties, and obtaining consent may impede the execution of such duties

Where Personal Information is provided for joint use in accordance with the next Article, after prior notification or public disclosure of the required matters
Notwithstanding the above, the following cases do not constitute provision to a third party:

Entrusting the handling of Personal Information to a service provider within the scope necessary to achieve the purposes of use

Provision of Personal Information in connection with business succession due to merger, corporate split, transfer of business, or other similar transactions
When entrusting Personal Information to a contractor, the Company will appropriately supervise such contractor to ensure proper handling.
Article 6 (Joint Use)
At present, the Company does not jointly use Users’ Personal Data with any specified third parties.
If joint use is introduced in the future, the Company will publicly announce, in advance and in accordance with the APPI, the categories of information to be jointly used, the scope of joint users, the purposes of use, and the party responsible for management.
Article 7 (Provision to Third Parties Located Overseas)
Because the Site is operated using the Shopify platform (Shopify Inc. and its affiliates), portions of User Information may be stored on servers located outside Japan (e.g., Canada, the United States).
When providing Personal Data to third parties located overseas, the Company will verify the relevant foreign personal information protection regime and the recipient’s handling structure, and will take appropriate protective measures via contracts or other means, in accordance with the APPI.
By using the Site, Users are deemed to have consented in advance to the possibility of such overseas data transfers within the above scope.
Article 8 (Use of Cookies and Similar Technologies)
The Company may use cookies and similar technologies (“Cookies”) on the Site for the following purposes:

Maintaining login status and retaining cart information

Understanding access status and analyzing usage to improve the Site

Displaying content and advertisements tailored to User interests (including remarketing)
Users may refuse Cookies through their browser settings; however, some Site functionality may not operate properly.

Article 9 (Security Measures)
To prevent unauthorized access, loss, destruction, alteration, or leakage of User Information, the Company implements security measures in accordance with the APPI and relevant guidelines, including:

Organizational measures: designation of personnel responsible for handling, establishment of handling rules, access-right management, internal inspections

Human measures: employee education and training, confidentiality obligations

Physical measures: access restrictions, secure management of devices and documents

Technical measures: password management, access logs, encryption, firewalls, antivirus software
The Company also exercises necessary and appropriate supervision over contractors handling Personal Information.
Article 10 (Retention Period)
The Company retains User Information for a reasonable period necessary to achieve the purposes of use.
Information for which a statutory retention period is prescribed will be retained for the legally required period and then deleted or anonymized by appropriate methods.
Users may request deletion of their account pursuant to Company procedures; however, information subject to statutory retention obligations may not be deleted.
Article 11 (Information of Minors / Persons Under 20)
The primary products handled on the Site are alcoholic beverages. Under Japanese law, individuals under 20 years old are prohibited from purchasing or consuming alcohol.
Accordingly, the Company does not permit the use of the Site (particularly product purchases) by persons under 20 and does not intentionally collect their Personal Information.
If it becomes evident that information from a person under 20 has been collected, the Company will promptly take necessary measures such as suspension of use or deletion.

Article 12 (Requests for Disclosure, Correction, Discontinuance of Use, etc.)
Users may, within the scope permitted by the APPI, make the following requests with respect to their Retained Personal Data:

The Company will verify identity through prescribed procedures and respond appropriately in accordance with the law.
In cases where there is no legal obligation to disclose or where disclosure may significantly impede the Company’s operations, the Company may decline the request in accordance with law.
Article 13 (Behavioral Targeting Advertising)
The Company may utilize behavioral-targeting advertising services provided by advertising companies, which may use Cookies to obtain and use browsing history or similar data.
Users may disable certain behavioral advertising by using the opt-out pages provided by the respective advertising companies.

Article 14 (Amendment of this Policy)
The Company may amend this Policy in response to revisions to the APPI or other laws/guidelines, or due to changes in the services provided through the Site.
In the event of amendment, the Company will publicly announce the amended Policy and the effective date via the Site or by other appropriate means.
Users who continue to use the Site after the effective date will be deemed to have agreed to the amended Policy.
